Silver City, NM – On October 27, the New Mexico State Police Investigations Bureau was requested to investigate an Officer Involved Shooting (OIS) in Silver City involving the Silver City Police Department.

 

State Police Investigations Bureau agents learned that at about 3:00 p.m., Silver City Police Department officers attempted to serve an outstanding arrest warrant for burglary on Trevor Franco, 32, near the Hillside Apartments located at 2545 N. Silver Street.

 

As officers approached Franco, he ran inside his house located at 2602 Yucca Street. Officers obtained a search warrant for the residence. When officers entered the residence Franco was holding a knife to his girlfriend’s neck. 

 

During the encounter, an officer with the Silver City Police Department fired his duty firearm at least once striking and injuring Franco. He was taken to an area hospital and ultimately airlifted to an El Paso, TX hospital. His current condition is not known.

 

Upon his release from the hospital, Franco will be booked on the charges of:

 

  1. Kidnapping, a First-Degree Felony.
  2. Aggravated Battery on a Household Member with a Deadly Weapon, a Third-Degree Felony.
  3. Aggravated Battery on a Household Member by Strangulation, a Third-Degree Felony.
  4. Assault on a Household Member with Intent to Commit a Violent Felony, a Third-Degree Felony.
  5. Resisting, Evading, or Obstructing an Officer

     

    The New Mexico State Police Investigations Bureau agents are working to independently determine the series of events leading to the shooting, including collecting evidence and conducting interviews. Throughout the process, investigative findings will be shared with the district attorney for their review and consideration.

    The New Mexico State Police acts solely as factfinders in its cases and does not determine whether the actions of an officer were justified in these types of matters. That decision rests with the district attorney’s office. This incident remains under investigation by the New Mexico State Police.
