Post-Conviction Testing of DNA Evidence to Exonerate the Innocent
The Department of Justice National Institute of Justice’s Post-Conviction Testing of DNA Evidence to Exonerate the Innocent program provides funding to assist in defraying the costs associated with post-conviction DNA testing in cases of violent felony offenses (as defined by State law) in which actual innocence might be demonstrated.
The New Mexico Department of Public Safety (NMDPS), has partnered with the University of New Mexico School of Law’s Innocence and Justice Project (IJP), and the NMDPS’s Northern Forensic Laboratory to provide post-conviction investigative DNA and legal services and to assist the factually innocent incarcerated in New Mexico since 2009. Currently, the Innocence and Justice Project at the University of New Mexico School of Law is the only resource for indigent men and women convicted in New Mexico state courts and incarcerated in New Mexico state prisons who claim to be factually innocent. The IJP, and NMDPS NFL also work with the Criminal Procedure Rules Committee of the New Mexico Supreme Court, New Mexico state legislators and others in the criminal justice system to educate the system about the importance of DNA testing and the adequate preservation of physical and biological evidence.
